UNITED NATIONS CONVENTION ABOUT THE REFUGEE STATUTE

Considerando que a Carta das Nações Unidas e a Declaração Universal dos Direitos Humanos aprovada em 10 de dezembro de 1948 pela Assembléia Geral afirmaram o princípio de que os seres humanos, sem distinção, devem gozar dos direitos humanos e das liberdades fundamentais;
Considering the United Nations Charter and the Universal Declaration Human Rights, approved at December 10th, 1948, by the General Assembly, whom secure the right of the humans beings, without distinctions, must enjoy of humans rights and the fundamental freedom;
Considerando que a Organização da Nações Unidas tem repetidamente manifestado a sua profunda preocupação pelos refugiados e que ela tem se esforçado por assegurar a estes o exercício mais amplo possível dos direitos humanos e das liberdades fundamentais;
Considering that, the United Nations Organization had repeatedly shown its great worry about refugees and for them making great effort to secure their humans rights and their fundamental freedom;
Considerando que é desejável rever e codificar os acordos internacionais anteriores relativos ao estatuto dos refugiados e estender a aplicação desses instrumentos e a proteção que eles oferecem por meio de um novo acordo;
Considering that is desirable review and codify the international treaties of refugee’s statute and extend the application of these tools and the protection that they offers by a new treaty;
Considerando que, da concessão do direito de asilo pode resultar encargos indevidamente pesados para certos países, e que a solução satisfatória dos problemas cujo alcance e natureza internacionais a Organização da Nações Unidas reconheceu, não pode, portanto, ser obtida sem cooperação internacional;
Considering that, from concession of the right of exile could result in heavy charges for some countries and the satisfactory answer of the problems that the international reach and nature the UNO recognized, cannot get without international cooperation;
Exprimindo o desejo de que todos os Estados, reconhecendo o caráter social e humanitário do problema dos refugiados, façam tudo o que esteja ao seu alcance para evitar que esse problema se torne causa de tensão entre os Estados.
Showing the wish that all the Countries, recognizing the social and humanitarian ethos of the refugees’ problem, do all they can to avoid this problem became the reason of States’ tension. ( … )

CARTAGENA DECLARATION ABOUT REFUGEES IN LATIN AMERICA
NOVEMBER 22, 1984
Promover dentro dos países da região a adoção de normas internas que facilitem a aplicação da Convenção e do Protocolo e, em caso de necessidade, que estabeleçam os procedimentos e afetem recursos internos para a proteção dos refugiados. Propiciar, igualmente, que a adoção de normas de direito interno sigam os princípios e critérios da Convenção e do Protocolo, colaborando assim no processo necessário à harmonização sistemática das legislações nacionais em matéria de refugiados.
Promote, inside of the countries of the region, the adoption of intern laws which helps the application of Convention and the Protocol and, in case of necessity, establish the procedures who affects internal resources for the refugees’ protection. Allow, with equality, that the adoption of internal rights’ laws follows the criteria and the principles of the Convention and the Protocol, helping at the process for the systematic harmonization of the national legislation about refugees.
Instar as organizações não governamentais, internacionais e nacionais a prosseguirem o seu incomensurável trabalho, coordenando a sua ação com o ACNUR e com as autoridades nacionais do país de asilo, de acordo com as diretrizes dadas por estas autoridades.
Urge the non-governmental organizations, internationals and national ones, to keep their immensurable work, coordinating their actions with ACNUR and the national authorities of the exile’s country, according with directions given by these authorities.
Promover a utilização, com maior intensidade, dos organismos competentes do sistema interamericano e, em especial, a Comissão Interamericana de Direitos Humanos com o propósito de complementar a proteção internacional dos asilados e refugiados. Desde já, para o cumprimento dessas funções, o Colóquio considera que seria aconselhável acentuar a estreita coordenação e cooperação existente entre a Comissão e o ACNUR.
Promote the use, with a bigger intensity, of the eligible organisms of the Inter-American system and, particularly, the Inter-American Commission of the Human Rights, with the objective of support the international protection of the exiled and refugees ones. From this moment, for the fulfillment of these functions, the Colloquy considers that could be desirable highlights the close coordination and cooperation between the Commission and ACNUR. ( … )

FEDERAL LAW N. 9.474 , JULY 22, 1997
Art. 1º – Será reconhecido como refugiado todo indivíduo que:
Art. 1° – Will be recognized “Refugee” everyone who:
I – devido a fundados temores de perseguição por motivos de raça, religião, nacionalidade, grupo social ou opiniões políticas encontre-se fora de seu país de nacionalidade e não possa ou não queira acolher-se à proteção de tal país;
I – because of the fear of harassment, due to race or ethnicity, religion, place of birth, social group or political opinion who is out of your birth country and cannot or do not want his/her country’s protection;
II – não tendo nacionalidade e estando fora do país onde antes teve sua residência habitual, não possa ou não queira regressar a ele, em função das circunstâncias descritas no inciso anterior;
II – Hasn’t any nationality and, outside of the country where was his/her habitual residence, can not or don’t want came back to this country, because of issues described at Item I.
III – devido a grave e generalizada violação de direitos humanos, é obrigado a deixar seu país de nacionalidade para buscar refúgio em outro país.
